Notion

Shift work is a way of working where several groups of workers take turns at the same workstation. Employees are usually divided into day, evening and night shifts. The shifts sometimes follow each other continuously, 7 days a week and 24 hours a day.

Authorization

Due to the strenuous nature of this type of work, shift work is only possible under special conditions. The company must, in most cases, apply for a permit from the competent authorities since it may involve night and Sunday work.

Health

In the context of teamwork, each employee participates, in principle, in all shifts in rotation. This work organization is rather difficult and the health of the employee can be endangered if the employer does not take the necessary and adequate measures.

Modalities

In order to compensate for the increased fatigue that results from this type of work, the employee benefits from special protection. He/she benefits from specific rest periods that the employer must imperatively respect.

Overtime

When working in shifts, the employee benefits from special premiums when working at night, on Sundays or on public holidays. When the employer pays the overtime accomplished by his or her employees, must he/she include these premiums in the salary to be paid to the employee?
